CDC issues national eviction moratorium

UPDATE – SINCE RECORDING THIS VIDEO, ZONA LAW HAS DECIDED, UNTIL FURTHER CLARIFICATION IS PROVIDED, IF A RESIDENT PROVIDES A SIGNED CDC DECLARATION, OWNERS SHOULD DISMISS ANY PENDING EVICTION ACTION AND NOT PROCEED TO A JUDGMENT OR WRIT.

Zona Law attorneys Scott Baluha and Mark Zinman address the 9/1/20 publication (to be effective 9/4/20) from the CDC creating a national moratorium on evictions for non-payment of rent cases if the resident signs a declaration avowing to certain factual matters. There are unanswered questions given the language in the Order. What is clear is that there are significant penalties and landlords must be very careful taking any legal action and review with their attorneys any documents they get from residents regarding this matter.
